By downloading, installing, or using the Pillwatcher mobile application ("App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Pillwatcher is a medication reminder and tracking application designed to help users manage their medication schedules, log medication intake, and maintain a record of medication adherence.

Key features include:

  • Thoughtful medication reminders and notifications
  • Quick in-app confirmation of medication intake
  • Hands-free voice recognition and optional photo capture for dose logging
  • Medication adherence history and timeline
  • Multiple medication tracking with custom schedules

3. Medical Disclaimer

IMPORTANT: Pillwatcher is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. The App is a medication reminder and tracking tool only.

You acknowledge and agree that:

  • The App does NOT replace professional medical advice, diagnosis, or treatment
  • You must consult with qualified healthcare professionals for all medical decisions
  • The App does NOT provide medical recommendations or advice
  • You are solely responsible for taking your medications as prescribed by your healthcare provider
  • The App's reminders are for convenience only and should not be your sole method of remembering medications
  • ED5X is not responsible for any health consequences resulting from missed doses, incorrect dosing, or reliance on the App

If you experience a medical emergency, call emergency services immediately. Do not rely on the App for emergency situations.

4. User Responsibilities

As a user of Pillwatcher, you agree to:

  • Accurately enter all medication information, including names, dosages, and schedules
  • Verify that all information entered into the App is correct
  • Take medications only as prescribed by your healthcare provider
  • Maintain regular communication with your healthcare providers about your medications
  • Ensure your device has sufficient battery and notifications enabled for reminders to function
  • Keep your medication information up to date when prescriptions change
  • Use the App only for lawful purposes and not to track controlled substances illegally
  • Not share your medication photos or data inappropriately

5. Privacy and Data Collection

Your privacy is important to us. The App collects and stores medication information, photos you choose to take, and adherence history to provide its core functionality.

Key privacy points:

  • Your medication data is stored privately and not shared without your consent
  • Voice is processed on-device only and not stored
  • Photos you take are stored locally for your record-keeping
  • We do not sell your health information to third parties

6. Subscription and Payment

Pillwatcher is a subscription-based service. Access to the App's features requires an active subscription.

Subscription Terms:

  • Subscriptions are billed through Apple's App Store
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings
  • Refunds are handled according to Apple's App Store refund policy
  • If you cancel, you will retain access to subscription features until the end of the current billing period

We reserve the right to modify subscription pricing with advance notice to existing subscribers.

7. Voice Recognition and Photo Capture

The App offers optional features to log medication intake through hands-free voice recognition or by taking photos.

You acknowledge and understand that:

  • The App does NOT verify that you actually took your medication
  • Voice recognition converts your speech to text for hands-free logging only; voice audio is processed on-device and immediately discarded, never stored
  • Photos you choose to take are stored on your device for your own record-keeping
  • These features are memory aids only - the App cannot and does not confirm, validate, or verify medication intake
  • You are responsible for honestly and accurately logging your medication intake
  • Logged data (confirmations and photos) does not constitute legal or medical proof of medication intake
  • The App relies entirely on your self-reporting; it has no capability to determine if you actually took medication

8. Accuracy of Information

You are solely responsible for ensuring that all medication information entered into the App is accurate and current. ED5X is not responsible for errors in medication names, dosages, schedules, or any consequences resulting from incorrect information.

The App relies entirely on the information you provide. Always check medication details against your prescription labels and healthcare providers.

9. Limitation of Liability

To the maximum extent permitted by law, ED5X and its affiliates, officers, employees, and agents shall not be liable for:

  • Any health outcomes or medical consequences related to medication use or non-use
  • Missed doses due to App malfunction, device issues, or notification failures
  • Incorrect medication information entered by users
  • Loss or corruption of medication data or adherence history
  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or use of the App
  • Interruptions or errors in the App's functionality
  • Reliance on the App for critical medication management

The App is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, secure, or continuously available.

YOU USE THE APP AT YOUR OWN RISK. In no event shall ED5X's total liability to you exceed the amount you have paid for the App subscription in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ED5X from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms of Service
  • Your violation of any laws or regulations
  • Incorrect medication information you enter into the App
  • Your medication decisions or adherence
  • Any health outcomes related to your medication use

11. Intellectual Property Rights

The App, including its design, functionality, features, and code, is owned by ED5X and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not:

  • Copy, modify, distribute, sell, or reverse engineer the App
  • Use the App for commercial purposes without authorization
  • Remove any copyright or proprietary notices
  • Access the App's source code or create derivative works

12. Device Compatibility and Requirements

Pillwatcher requires an iPhone running a compatible version of iOS. You are responsible for:

  • Ensuring your device meets minimum requirements
  • Maintaining device battery and functionality for reminders to work
  • Enabling notifications and granting necessary permissions
  • Any data charges incurred while downloading or using the App

13. Third-Party Services

The App may integrate with third-party services (such as Apple's notification system). Your use of these services is subject to their respective terms and conditions. ED5X is not responsible for the performance or availability of third-party services.

14. Changes to the App and Terms

We reserve the right to:

  • Modify, update, or discontinue the App or any features at any time
  • Update these Terms of Service at our discretion

Material changes to these terms will be posted on this page with an updated "Last Updated" date. We may also notify you through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated terms.

15. Termination

You may stop using the App at any time by canceling your subscription and deleting the App from your device. We reserve the right to terminate or restrict your access to the App if you violate these Terms of Service.

Upon termination, your license to use the App ends immediately, though you may retain access until the end of your current billing period if you paid for a subscription.

16. Healthcare Provider Sharing

The App allows you to review your medication adherence history, which you may choose to share with your healthcare providers. You are responsible for how you share this information. ED5X does not automatically share your data with healthcare providers.

17. Governing Law and Disputes

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which ED5X operates, without regard to conflict of law principles.

Any disputes arising from these terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.
